The Chapter that best fits your needs and your situation depends on the particulars of your finances, your assets and your current income. A bankruptcy filing under Chapter 7 of the Bankruptcy Code is commonly known as a 'liquidation' bankruptcy. Upon filing, a debtor (the person with the debt is the debtor) lists all of his or her assets. We will protect all of your assets with the use of exemptions, governed by California state laws.
Exemptions are laws that protect your property when filing a bankruptcy case. Bankruptcy law is not designed to strip you of all your property, normally we can protect all of your property and get rid of your debt too!
When the initial petition is filed with the US Bankruptcy Court, which includes all assets, debts and exemptions, it is assigned to a Bankruptcy Trustee and a Notice is sent to the creditors named on the petition. The trustee sets a date for a hearing, called a 341 Meeting of Creditors. Normally, this hearing takes just a few minutes and there are not usually creditors present at the hearing. However, creditors may attend if they wish to but it is rare that they actually do.
Additionally, upon filing your case, an "Automatic Stay" issues which prevents any and all creditors from any collection action against the debtor.
After the creditors' meeting, a debtor usually receives a discharge 60-90 days thereafter and you are DEBT FREE!
Most debts can be wiped out, however, there are some debts that cannot be eliminated by bankruptcy. We can discuss this with you at a case evaluation.
The Chapter 13 filing is generally known as the 'wage earner's' bankruptcy. The reason is that instead of filing for liquidation-style protection, the debtor instead files a re-payment plan of debts that last 3-5 years. A plan is created the best suits the debtors financial situation at the time of filing the case. Most debtors can keep all their property when filing this type of case.
After filing the re-payment plan, the plan is then confirmed. The debtor then must make the agreed-upon plan payment for 3-5 years to the assigned bankruptcy trustee in their case. The trustee's role is to oversee the case and to distribute payments to the creditors listed in the case. Once the plan has been completed, any remaining debts are discharged and you get a FRESH START!
